Agreement to terms

By accessing or using the Team 218 Web Services website (team218.com) or engaging our services, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, please do not use our website or services.

Services

Team 218 Web Services provides custom WordPress web design, search engine optimization (SEO), generative engine optimization (GEO), WordPress maintenance and care, WordPress repair, and social media management for businesses and nonprofits. The specific scope, deliverables, and timeline for any project are defined in a written working agreement between Team 218 and the client prior to work beginning.

Working agreements

All projects are governed by a separate working agreement that outlines the project scope, deliverables, timeline, and pricing. These terms and conditions supplement but do not replace the working agreement. In the event of a conflict between these terms and a signed working agreement, the working agreement takes precedence.

Payment terms

Team 218 does not require deposits or upfront payment. Payment is invoiced after the project is complete, the website is live, and the client is satisfied with the result. Payment is due within 30 days of invoice unless otherwise specified in the working agreement. We accept payment via digital invoice with online payment options.

Website ownership

Upon full payment, the client owns their website, including all custom design work, content, and code created specifically for their project. The website is built on WordPress and hosted on the client's own hosting account. The client retains full ownership of their domain name, hosting account, database, and all associated files. Team 218 does not retain ownership of or restrict access to any client website or its components.

What the client owns

The custom design, page layouts, and content created for the project. All files, databases, and media uploaded to the client's hosting account. The domain name registered to or transferred to the client.

What the client does not own

Third-party software, plugins, themes, and frameworks used in the build (such as WordPress and Divi) are licensed separately under their respective terms. Stock images, if used, are licensed under the terms of their respective providers.

Maintenance and care

Every web design project includes 12 months of WordPress maintenance and care at no additional cost. This includes daily backups, WordPress core and plugin updates, security monitoring, uptime monitoring, and minor content updates. After the initial 12-month period, ongoing maintenance is available at $60 per month, invoiced annually ($720 per year). Maintenance services may be cancelled at any time.

Client responsibilities

The client is responsible for providing content, images, logos, and other materials needed for the project in a timely manner. Delays in providing requested materials may affect the project timeline. The client is responsible for reviewing and approving work at each stage of the project. The client is responsible for maintaining their hosting account, domain registration, and any third-party service subscriptions after launch.

Revisions and changes

Reasonable revisions are included in every project as part of the collaborative design process. Revisions that fall within the original project scope are included at no additional cost. Requests that expand the scope of the project (additional pages, new features, or functionality not included in the working agreement) will be discussed and quoted separately before work begins.

Third-party services

Team 218 may recommend third-party services including but not limited to web hosting (NameHero), domain registration, Google Workspace, analytics platforms, and form tools (Gravity Forms). These services are provided by their respective companies under their own terms. Team 218 is not responsible for the performance, availability, pricing changes, or terms of any third-party service.

Limitation of liability

Team 218 Web Services provides web design, SEO, and related digital services on a best-effort basis. We do not guarantee specific search engine rankings, traffic levels, or business outcomes. Search engine algorithms, market conditions, and competitive factors are outside our control.

To the maximum extent permitted by law, Team 218 Web Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website or services, including but not limited to loss of revenue, data, or business opportunities.

Our total liability for any claim arising from our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim.

Intellectual property

All content on team218.com, including text, images, graphics, logos, and code, is the property of Team 218 Web Services unless otherwise noted. You may not reproduce, distribute, or create derivative works from our website content without written permission.

Website use

You may use team218.com for lawful purposes only. You agree not to use the website in any way that could damage, disable, or impair the site or interfere with any other party's use of the site. You agree not to submit false or misleading information through any form on the website. You agree not to attempt to gain unauthorized access to any part of the website or its associated systems.

Privacy

Information collected through our website forms (name, email, phone, website URL, and project details) is used solely to respond to your inquiry and provide our services. We do not sell, rent, or share your personal information with third parties. For complete details, see our Privacy Policy.

Termination

Either party may terminate a project or ongoing service at any time by providing written notice. If the client terminates a project before completion, payment is due for all work completed to that point. If Team 218 terminates a project, we will deliver all work completed to that point and no further payment is due from the client.

Dispute resolution

Any disputes arising from these terms or our services shall first be addressed through good-faith communication between the parties. If a resolution cannot be reached, disputes shall be governed by the laws of the State of Iowa and resolved in the courts of Iowa County, Iowa.

Changes to these terms

Team 218 reserves the right to update these terms at any time. Changes take effect immediately upon posting to this page. The "last updated" date at the top of this page reflects the most recent revision. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
